Уже два года пишут эксперты и журналисты про последствия нового Жилищного Кодекса РФ. Самая страшная статья - 31 и поправки в 292-ю статью ГК РФ. Суть - собственники жилья получили НЕОГРАНИЧЕННУЮ возможность выселять бывших (и даже реальных) членов семей. В том числе и несовершеннолетних детей. В кодексе такая возможность прямо не прописана, но Верховный Суд разъяснил 31 статью ЖК РФ и оказалось, что и несовершеннолетние дети, при разводе остающиеся с родителем (чаще всего с матерью) - пользователем жилья, могут быть признаны БЫВШИМИ ЧЛЕНАМИ СЕМЬИ собственника и, соответвенно, выселены на улицу. В Москве - десятки детей уже выселены или на грани выселения. Возможно, таких уже тысячи, только мы о них не знаем. Вероятно, по России последствия 31 статьи ЖК РФ уже катастрофичны. Депутаты Ярославского ЗАКСа рассказывали в Госдуме на комитете по законодательству, что выселенные матери отдают своих детей в детские дома, так как жить им негде. According to the new Housing Code in Russia and especially the section 31, the owners of the house have the UNCONTROLLED right to evict former (and even present) family members including children. It is because children that after the divorce stay with another parent (usually mother) who is user of the house are considered FORMER FAMILY MEMBERS and thus can be evicted. In Moscow there are dozens of children who have been already evicted or will be evicted soon. May be in whole Russia they are thousands but we don't know yet. In Yaroslavl the evicted mothers are leaving their children in orphanages because they have nowhere to live.
