GOOGLE CEO Eric Schmidt phoned YAHOO's Jerry Yang on Friday to offer some sort of help in avoiding a MICROSOFT takeover. No details of the call have been released but there is speculation that it could involve Yahoo outsourcing its search business to Google. Google has posted a reaction to the takeover bid on its blog, saying a combined Microsoft-Yahoo will threaten the openness and innovation of the Internet. Microsoft's General Counsel responded by saying the deal would "create a more competitive marketplace." Meanwhile, the House of Representatives has scheduled a hearing on the issue for this Friday. CABLEVISION is expected to officially announce a new service that offers a combination of DVD purchasing and instant VOD access to content. Viewers will be able to order a DVD through a VOD channel on the same day it hits stores and then begin watching the feature immediately. The service is a partnership with Popcorn Home Entertainment. Content will be available from Warner Bros. and Universal. THE WGA and the AMPTP have reportedly made major breakthroughs in negotiation talks and an agreement is expected soon. Streaming rights have been agreed upon and lawyers are drafting contracts, which will be reviewed by the negotiating committees. However, the Guild presidents have told its members that no deal is firmly in place yet and that picketing must continue. ESPN will slightly open the gate to ESPN 360's walled garden, offering free access to users in the .edu and .mil domains and potentially doubling its audience. The site offers live, online streaming of full-length sporting events. Until now it has only been available to users whose ISP's have cut deals with ESPN. The company is hoping to migrate the cable business model to the web but this may be a sign that this approach is not working. NATIONAL GEOGRAPHIC is launching a reorganized broadband video site with multiple genre channels. 1500 clips will be offered with ad support. Most clips will be short, with a new long video added each week. The reorganization comes after Nation Geographic found much higher activity on the NGC Wild site, which uses the genre model. THE RECORDING INDUSTRY lost a major ruling in Atlantic v. Brennan when a federal judge in Connecticut ruled that merely making music available to other users is not evidence of copyright infringement. The judge also found that no proof of infringement was supplied by the record companies that brought the suit. With two of three findings going to the defendant, the case was thrown out. GOOGLE suffered a 7% drop in ad clicks from December to January and a .3% drop year over year according to comScore. Clicks also declined 7% between November and December. Wall Street responded to the news by hammering down Google's stock by as much as 8% during trading on Tuesday. While the company has not verified comScore's findings it did officially report substantially slowed growth during the fourth quarter. The cause may be any number of factors, from a tightening economy to increased success in battling click fraud. CBS reported a 15% decline in Q4 revenue and flat ad revenue due to slowdowns in TV and radio. Les Moonves said that the company would cutback on pilot expenditures, calling them "vastly overrated." He also tried to ease concerns about the slowing TV business by saying that "Network TV will always be a must-buy" for advertisers. (Maybe.) In other TV-slowdown news, DISH saw a 76% decline in subscriber gains during Q4. APPLE announced that iTunes has become the number two music retailer in the US, trailing only Wal-Mart in music sales during 2007. The store has 50 million customers and has sold 4 billion songs to date. The iTunes juggernaut continues. THE WGA ratified the new contract with the AMPTP with 93% of members voting to approve the deal. The contract is retroactive to February 13th and will be in effect until May 2, 2011. And the focus shifts to SAG. NBC UNIVERSAL will soon close the beta period for NBC Direct. The download service will officially launch sometime this quarter, though no specific date has been announced. NBC Direct will offer automatic copy-protected downloads of top NBC shows, including "The Office" and Conan O'Brien. Let's hope they fulfill the promise of Mac support in a reasonable time frame. ESPN will offer substantial online coverage of its first Masters tournament. Live streaming of the event will be offered to the handful of people that can actually access ESPN360.com. For the rest of us, video exclusives will be posted on Masters.org and live "look ins" will be available on ESPN.com. HBO will soon begin testing HBO on Broadband, a service that will allow current subscribers to watch the channel's content online. The service requires a PC application that offers both automatic downloads and live streams of HBO channels. The service will enter a trial period this week in Green Bay and Milwaukee before spreading to other parts of the country. THE WGA will meet informally with studio heads this week to discuss a possible return to the bargaining table. The Guild will send West Coast President Patric Verrone and Executive Director David Young to meet with Disney chief Bob Iger and News. Corp. President Peter Chernin. In related news, the WGA has scheduled a major rally in Manhattan on Tuesday, the day Oscar nominations are announced. Meanwhile, the fallout from the strike continued as CBS has canceled around 20 projects that were in development. JEFF ZUCKER told the Financial Times that he intends to use the current writers strike as a catalyst to remove inefficiencies from NBC - including pilot season, the upfront, and more. Zucker called them "vestiges of an era that's gone by and won't return." He predicted that the development process will change in the near future and said the strike has hastened a change that would have been necessary eventually. YAHOO will reportedly layoff up to 20% of its workforce in the next two weeks. Both Silicon Valley Insider and TechCrunch's Michael Arrington have reported on the pending layoffs, saying that the announcement could come during the company's earnings call on January 29th. 1500 to 2500 people may be affected. The potential downsizing would be the result of a project during Q4 that sought out redundancies and waste within the company. CEO Jerry Yang is expected to make the decision this week. GETTY IMAGES will soon put itself up for sale and has hired Goldman Sachs to facilitate the deal. The company offers high-quality photographs for use in print, video and elsewhereand has over 4 million visitors to its website every month. However, low-cost rivals and amateur UGC sites such as Flickr have challenged its business model and undercut its pricing. Getty recently acquired iStockPhoto, one of its cheaper competitors. On February 10, 2008, the Writers Guild of America held a press conference to announce that the WGA Negotiating Committee has unanimously recommended the terms of the proposed 2008 MBA to the WGAW Board and WGAE Council. The Board and Council then voted unanimously to recommend the contract and to submit it to the joint membership of the WGAW and WGAE for ratification. Additionally, the Board and Council called for a special vote by the membership on February 12 on whether to lift the restraining order and end the strike during the ratification process. WGA West President Patric Verrone, Negotiating Committee Chair John Bowman and Chief Negotiator David Young answered questions from the press.
